On November 19, 2022, the Dalat University Faculty of Law Studies collaborated with Tilleke & Gibbins Vietnam (T&G Vietnam) to organize the conference on Law on intellectual property in the digital environment in Vietnam This conference is part of a series of activities to celebrate the 20th anniversary of the establishment of the Dalat University Faculty of Law Studies.
The conference has received great attention from scientists, agencies, and businesses with many submissions from 17 universities across the country. Attending the conference, on the side of Dalat University, were Dr. Mai Minh Nhat – Member of the Standing Committee of the Party Committee – Vice President of Dalat University and leaders of functional departments; Dr. Nguyen Thi Loan – Dean of the Faculty of Law Studies; Dr. Nguyen Van Nghiep – Vice Dean of the Faculty of Law Studies; Dr. Tran Thi Ngoc Kim – Vice Dean cum Deputy Head of the Department of Administration and Justice; Ms. Vo Thi Thanh Linh – Deputy Head of the Department of Economic – International Law; lecturers and students of the Faculty of Law Studies. On the side of T&G Vietnam, there were Mr. Nguyen Tuan Hung – Deputy Head of Patent Department; Mr. Le Xuan Loc – Head of Intellectual Property Rights Enforcement Department; Ms. Vu Thi Thanh Binh – Lawyer, Human Resources Director; Ms. Nguyen Thi Mai Linh – Head of Brand Department; Mr. Eric Minh Huu Huy – Head of Marketing and Sales Department, and eight lawyers of the company. Besides, the conference also welcomed Mr. Tran Giang Khue – Deputy General Secretary of Vietnam Invention Association and intellectual property expert; Mr. Luong Le Minh – Vietnam Competition and Consumer Authority, Ministry of Industry and Trade; Ms. Dang Thi Tam – Judge of the People’s Court of Ho Chi Minh City; Dr. Nguyen Phuong Thao – Ho Chi Minh City University of Law; lecturers from many universities in the country.
Speaking at the opening of the conference, Dr. Mai Minh Nhat – member of the Standing Committee of the Party Committee – Vice President of Dalat University sincerely thanked the partner, T&G Vietnam. Tilleke & Gibbins is a leading law firm in Southeast Asia with more than 200 lawyers and consultants working in representative offices in Cambodia, Indonesia, Laos, Myanmar, Thailand, and Vietnam. In addition, representatives of the Dalat University Executive Board thanked the administrators of universities across the country for their interest in the conference and for creating conditions for the lecturers to submit research articles to the conference. He also sent thanks to the experts, judges, and scientists who attended the workshop and wished the education and research career of the Faculty of Law Studies to keep evolving.
The workshop was chaired by Mr. Tran Giang Khue – Deputy General Secretary of the Vietnam Invention Association and intellectual property expert; Dr. Nguyen Thi Loan – Dean of the Dalat University Faculty of Law Studies; Mr. Le Xuan Loc – Head of Intellectual Property Rights Enforcement Department of T&G Vietnam. Participants listened to 05 presentations:
- Mr. Tran Giang Khue – T&G Vietnam, intellectual property expert, Deputy General Secretary of Vietnam Invention Association with the presentation “Some challenges in the protection and enforcement of intellectual property rights in the digital environment”.
- Dr. Nguyen Phuong Thao – Faculty of Civil Law, Ho Chi Minh City University of Law with the presentation “Legal responsibilities of intermediary service providers for copyright infringement in the digital environment in Vietnam”.
- Vo Thi Thanh Linh – Deputy Head of Department of Economic – International Law, Faculty of Law Studies – Dalat University with the presentation “Law on protection of intellectual property rights in commercial advertising activities on social networks – Current status of some recommendations to improve the law”.
- Mr. Bach Hoang Giang – T&G Vietnam with the presentation“Dispute resolution between trademark owners and domain name registrants – From a legal perspective to practice”;
- Mr. Tran Bao Trung and Mr. Tran Anh Duc – T&G Vietnam with the presentation “Handling acts of infringing copyright and related rights for digital content in cyberspace”.
The conference received many opinions and ideas from the participants on legal aspects, arising issues of intellectual property in the digital environment: establishing ownership; exercise rights; Exploiting rights and challenges and difficulties in protecting the enforcement of intellectual property rights; The role of the intermediary organization, the specific types of liability of the intermediary service provider for copyright infringement in the digital environment, cases of liability exemption; Advertising infringing intellectual property rights on social networks; Proposing to improve the Law on Intellectual Property, Law on E-commerce; Domain name issues and trademark-related domain name disputes; Practice resolving trademark-related domain name disputes and proposing solutions; Handling acts of infringement of copyright and related rights for digital content in cyberspace.
Speaking at the end of the Conference, Dr. Nguyen Thi Loan – Dean of the Faculty of Law Studies and Mr. Le Xuan Loc – Head of Intellectual Property Rights Enforcement Department – T&G Vietnam, thanked universities, law training institutions, experts, and judges who submitted their papers and arranged time to attend the conference, and the Faculty of Law Studies – Dalat University who organized the conference carefully and thoroughly.
